TERMS AND CONDITIONS OF ATTENDANCE AND AGREEMENT OF RELEASE AND WAIVER OF LIABILITY

Retreat Facilitators: Kristine Morris and Artemis Evangelidis (the 'facilitators')

Workshop Providers: Dr. Sarah Temple and certified yoga instructor (to be confirmed) (the 'workshop providers')

By clicking ‘submit’ on the registration form, I hereby agree to the following:

1. As a participant in activities offered by the facilitators and any workshop providers or special guests, I understand that the offerings of this retreat are not a substitute for medical attention, examination, diagnosis, or treatment.

2. I will receive fitness related information and instruction. I recognize that all exercise programs require physical exertion that may be strenuous and may cause physical injury and I am fully aware of the risks and hazards.

3. If at any time during the activities I feel discomfort or pain, I will inform and seek assistance from the facilitators

4. I may rest at any time during the retreat. I will listen to my body and respect its limits on any given day.

5. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in any activity program. I represent and warrant that I am physically fit and I have no medical condition that would prevent my participation in fitness classes or workshops.

6. I recognize that it is my responsibility to notify the facilitators and the workshop providers of any serious illness or injury before every class.

7. I accept that neither the facilitators, the workshop providers nor the hosting facility, are liable for any injury, or damages, to person or property, resulting from my participation in this retreat.

8. CANCELLATION TERMS

I understand that the deposit for the retreat is final with no refunds and the balance of my payment is due no later than January 31, 2024 as outlined on the retreat website and this form depending on which payment option I have chosen. Cancellation fees will apply due to associated costs including but not limited to the accommodation, catering, workshop provider and facilitator fees, and all other expenses incurred by the facilitators as a result of organising the retreat. I agree that cancellations made after the 31st of January 2024 will be paid in full unless I can transfer my spot to another person.

9. MEDICAL CONDITIONS & SPECIAL REQUIREMENTS

You must inform the facilitators via this form of any medical conditions, pregnancy, disability or any other mental and or physical conditions which may affect fitness to travel, including medications you are currently taking. Failure to notify us may result in you being refused certain activities during the retreat at your own expense. Some activities may be unsuitable for you due to age, mobility, disability, pregnancy or physical or mental conditions. Please email us if you have concerns. It is absolutely vital that you are accurate with your fitness level and medical conditions for your own safety. The facilitators will do their best to meet special requests including dietary requirements or physical limitations but such requests may not always be possible and you acknowledge that this is the case.

10.PHOTOS, VIDEO AND CONTENT CREATION

During the course of your participation in the retreat, photos or video may be taken by the facilitators, participants, guides and professional photographers. These images may be used in any of the facilitators’ promotional materials, website, all social media platforms (i.e. Instagram), etc., unless you specifically request to us in writing not use any material your image is depicted in. Otherwise, permission is granted to the facilitators of a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.

11. LIMITED LIABILITY OF RETREAT FACILITATORS AND WORKSHOP PROVIDERS

11.1 The facilitators and workshop providers shall not be liable for any unusual and unforeseeable circumstances beyond their reasonable control, of which the consequences could not have been avoided even when exercising all reasonable care (a ‘Force Majeure Event’). Force Majeure Event(s) include, but are not limited to, pandemic and epidemic outbreaks, war or threat of war, riot, civil unrest, industrial disputes or strikes, accidents or failure to perform by third parties, including suppliers and subcontractors, unavoidable technical problems with the accommodation, transport or closure or congestion of airports, terrorist activity, natural disasters including floods, bushfires, industrial disasters, fire, theft, flooding and adverse weather conditions including snow storms and any incidents with wildlife. In the event of any the above, refunds and compensation payments cannot be made.

11.2 The facilitators and workshop providers accept no liability for loss, damage, injury or illnesses which may be suffered by you during your stay or travelling to and from the retreat centre.

11.3 All guests must take responsibility for their own medical and physical fitness and be able to use the facilities as stated herein and participate in activities.

11.4 The facilitators and workshop providers are not liable for any injuries or losses to guests, as a result of their use of retreat facilities or participation in activities.

11.5 Whilst all care is taken, the facilitators and workshop providers cannot accept any responsibility for loss or damage of personal possessions or valuables of guests.

11.6 In the event that the retreat is cancelled for any reason that is not contained in 11.1 herein, in other words, for any reason that is not due to a Force Majeure Event, all payments will be refunded minus a 10% administration fee.

12. DATA PROTECTION

To ensure that our retreat runs smoothly, the facilitators will need to use personal information (such as name, address, special needs, health conditions, dietary requirements etc.) provided by you to us, and also pass on such information to other outfitters/guides or suppliers involved in the operation of the retreat. The facilitators will apply appropriate security measures to protect such personal data and will only pass on data that is applicable to outfitters or suppliers responsible for the retreat. By completing our retreat registration form and clicking ‘Submit’, you consent to this information being transferred as required.

13. ACCEPTANCE OF RISK

You acknowledge that the nature of the retreat may involve personal risk. You hereby assume all such risk and hereby release the facilitators from all claims and causes of action arising from any damages or injuries or death resulting from these inherent risks.

I have read the above Terms and Conditions and Release and Waiver of Liability fully and I understand it’s contents as well as the refund/cancellation policies. I voluntarily agree to the terms and conditions as stated above.

I further agree to the following:

A. The information I have provided on this form is complete and accurate.

C. I understand the risks inherent in attending the retreat and participating in any of the activities and I agree to be solely responsible for any injuries sustained by me as a result of my participation at this retreat. I am fully aware of the risks involved.

I understand that it is my responsibility to consult with a physician prior to and regarding my participation in any activities offered at the retreat. I represent and warrant that I am physically fit and have no medical conditions that would prevent me from participation in any wellness workshops or yoga classes. I assume full responsibility for any injuries or damages, known or unknown, which I might incur because of participating in any sessions at the retreat. I knowingly, voluntarily, and expressly, waive any claim I may have against the facilitators for injuries or damages that I may sustain because of participating in their wellness workshop and retreats.

D. I will have travel insurance in place and or medical coverage in Canada during the dates of the retreat and acknowledge that I will provide copies of all relevant documents to the facilitators at least 14 days prior to the commencement of the retreat. Failure to do so may result in being denied entry to the retreat, forfeiting my place and I will not be entitled to any refunds.
